Basics and definitions

The Hallo Welt! GmbH, PO Box 11 02 09, 93015 Regensburg, hereinafter referred to as “Hallo Welt!”, provides a help wiki for the BlueSpice software on the Internet at http://wiki.bluespice.com. These terms of use apply to every user of the platform.

The Hallo Welt! GmbH ("Hallo Welt!") initiated the wiki and will moderate the platform for the time being.

Anyone who creates or edits content for the wiki as an author and/or editor is an "active user". Anyone who only reads such content or wants to use it for other purposes is a "passive user" within the meaning of these terms of use. Active and passive users are hereinafter collectively referred to as "users".

If you want to become an active user, you have to register with a user name, a password and an e-mail address. The other requirements for registration are regulated below in these terms of use.

This website contains links to third-party websites ("external links"). These websites are subject i.a. According to the provisions of the TMG (Telemedia Act), the area of responsibility of the respective person responsible for the website i.S.d. §§ 7 ff TMG. Hallo Welt! checked the third-party content for any legal violations when the external links were first linked. Hallo Welt! however, has not fully checked the information contained in the links for their correctness. Hallo Welt! has no influence on the current and future design and content of the linked pages. Setting external links does not mean that Hallo Welt! owns the content behind the reference or link and/or guarantees the correctness of the respective content. Permanent control of the external links is for Hallo Welt! unreasonable and not required by law without specific references to legal violations or errors in content. However, if we become aware of legal violations, such external links will be deleted immediately. Hallo Welt! will also delete links immediately if it should become aware that links refer to pages with obviously incorrect information.

Hallo Welt! reserves the right to change these terms of use at any time. Before each login, the user is informed of the currently applicable version of the terms of use. However, the user is not individually notified. Each user is responsible for reading the terms of use and checking that they are up to date before using the wiki. The further use of the platform by logging in after a change in the terms of use is considered a declaration of consent by the respective user with the changed terms of us

Information and obligations for active users (authors and editors)

  1. Any user who creates or changes content must allow all other users to use this content freely, as long as the original authors are named (with the first and last name of the author(s) and either the reproduction of a hyperlink or the URL on every website that is used), as well as the right to use this content freely.
  2. User therefore agrees that any content created by User is hereby licensed under the Creative Commons Attribution/Share-Alike License 3.0 (unported) license.
  3. Commercial use of the content by active users is permitted as long as these terms of use are observed.
  4. The user declares that he is either the author of the content he uses, in particular the texts, or has duly acquired the rights to use it.
  5. In this respect, the user is responsible for the content and contributions he uses and publishes in the wiki. Hallo Welt! is not obliged to check the legality of content before publication or to regularly check its website for possible illegal content. Illegal content is content that offends against common decency or the general sense of ethics or violates intellectual, commercial and other property rights of third parties, in particular copyright and trademark rights as well as general personal rights.
  6. After gaining knowledge of specific content and its illegality, Hallo Welt! is entitled to remove this content or to block access to it. Furthermore, Hallo Welt! is entitled to temporarily or permanently exclude the user who posted the illegal content from using the platform. Claims by the user due to the removal of content or the blocking of access to the content and/or due to the temporary or permanent blocking of the user himself are excluded.
  7. The user releases Hallo Welt! from all claims of third parties due to the violation of their rights by illegal content posted by the user. The user has to replace any damage to Hallo Welt! in particular where third parties sue Hallo Welt! for violation of their rights.

Information and obligations for passive users

  1. A passive user who wishes to use the content of the wiki for other purposes may use the content provided that they comply with these terms of use.
  2. For further use of the content of the wiki, the following conditions must be observed:
    • Identification of the authors (with first and last names and either reproduction of a hyperlink or the URL to each website that is used), as well as
    • a transfer of these terms of use, preferably with a hyperlink to wiki.bluespice.com
    • Indication of the changes and/or additions to the existing work in an appropriate manner.

Rights and obligations of Hallo Welt!

  1. Hallo Welt! makes the wiki available to the general public free of charge.
  2. The user has no legal right to permanent use of the platform. In particular, Hallo Welt! is not obliged to ensure that their service is available or accessible at all times. Hallo Welt! strives to keep the platform running as smoothly as possible and to further develop it according to the needs of the users. Hallo Welt! assumes no liability for the availability and freedom from defects of the platform.
  3. Hallo Welt! expressly reserves the right to change, restrict or completely discontinue the use of the platform at any time. The platform may be temporarily unavailable, in particular due to maintenance work, without the user being able to make any claims against Hallo Welt! would grow up.
  4. If the user violates these terms of use, Hallo Welt! is entitled to make use of their virtual domiciliary rights. This means that Hallo Welt! has the right to exclude the user concerned from the platform or parts of the platform with the help of a block and to completely delete the content used by that user. The exclusion takes place at reasonable discretion when evaluating the individual case and in particular taking into account the severity of the violation.
  5. Users of the platform are expressly advised that the dissemination of illegal content may result in criminal prosecution. In these cases Hallo Welt! is entitled and under certain circumstances obliged, if we become aware of illegal or illegal content or if we are aware of content that violates common decency, to remove it immediately and to save the respective content for evidence purposes. In these cases, Hallo Welt! is entitled to exclude the respective user from future use of the platform.

Other provisions

  1. If a provision of these terms of use proves to be ineffective, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, the parties will agree on the validity of an appropriate provision that comes closest to what the contracting parties wanted, but is permissible; The same applies to gaps in the contract.
  2. The exclusive place of jurisdiction for all legal disputes arising from this contract is Regensburg if the user is a merchant, a legal entity under public law or a special fund under public law or if the user has no place of jurisdiction in the Federal Republic of Germany.
  3. Applicable law for all disputes arising from this usage relationship is German law. Insofar as this refers to other legal regulations, this reference is excluded.
  4. In the event of inconsistencies between the English version and a translation into another language, the German version applies.
